Solihull Metropolitan Borough Council’s planning committee threw out the plan in March.
It found: “At this location, which is on the inside of a bend and opposite a junction, it is not considered to be in the interests of highway safety.”
Some 19 residents opposed the plan with fears over traffic and parking. There were also concerns that future plans would try to expand the nursery.
The council threw out a plan to let it take on 20 children in 2008 but the nursery overturned this on appeal at the inspectorate, though it refused permission for 36 children.
It then got permission from the council for two extra parking spaces, to six.
People can give their views to the inspectorate which can be contacted here.
