A planning application has been submitted to Solihull Metropolitan Borough Council for two detached houses of three and four bedrooms in the front of 21 and 21a Knowle Wood Road.
It comes after the Government changed the definition in planning law of previously developed land to no longer include gardens.
This would make it more difficult for developments in gardens to get planning permission, ministers argued.
But Progression Architects, for applicant Terry Webber, said the new law was over-ridden by exisiting laws which says development should put land to ‘efficient and sustainable use’.
It said: “The development of the exisitng garden space for new housing development is still an acceptable use of land provided that the development proposed relates well to and respects the existing built environment.”
It comes after another single home plan was refused for land at Spring Coppice Drive.
The council rejected the plan for land at the back of 62 Avenue Road, next to 1a Spring Coppice Drive.
It was submitted after the council threw out a plan for two detached four-bedroom homes in the garden last month. A similar plan was rejected in January.
The council’s planning committee refused the plan, below, “due to its excessive bulk, scale, massing and positioning on the site”.
