The application will be be decided by the national Planning Inspectorate after an appeal by Grand Union Marine and Leisure Services Ltd.
Solihull Metropolitan Borough Council rejected the plan and another, for off the Warwick Road, in December. No appeal has been lodged on the latter.
The firm wanted to create a new road off Jacobean Lane to the 140 berth marina, to the back of houses in Wychwood Avenue.
The council said the scheme would “not maintain the openness of the Green Belt”, would “unacceptably detract” from nearby grade II listed Grove Farm and posed a flooding risk.
The inspectorate hopes to have a decision by November. It will take evidence in either written form, a meeting with the parties or a public inquiry.
The council could have the pay the firm’s legal cost if it loses.
A letter to homeowners said: “The council has refused the planning application described above and the applicant has appealed to the secretary of state for the environment.
“The appeal is to be dealt with by the secretary of state on the basis of an inquiry and a site visit by an inspector who may be accompanied by the appelant and a council officer if necessary.”
It says ‘there can be no discussion of the case during the visit’ but residents can request the inspector view the proposed site from their property.
Comments submitted to the council planning application will be sent on to the inspector.
